未經特許人同意，任何人不得泄露、向他人透露或轉讓特許人的商業秘密。
Without the consent of the franchisor, anyone must not reveal, or
disclose or transfer to another person, the franchisor’s commercial
secrets.
當事人在訂立合同過程中知悉的商業秘密，無論合同是否成立，不得泄露或者不正當地使用。
A party may not disclose or improperly use any trade secret which
it became aware of in the course of negotiating a contract,
regardless of whether a contract is formed.
雙方都有義務保護對方的利益，雙方應該承諾相互為對方保守技術和商業秘密。
Both sides are all obligated to protect the interests of the other side,
both sides should promise it is the other side’s conservative
technology and business secret each other.
泄露或者不正當地使用該商業秘密給對方造成損失的，應當承擔損害賠償責任。
If the party disclosed or improperly used such trade secret, thereby
causing loss to the other party, it shall be liable for damages.
